1. Acceptance of Terms

By accessing or using the Nighsell platform ("Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Platform. Nighsell is a marketplace platform operating in Oman that connects customers with local vendors offering delivery and pickup services.

2. Use of the Platform

• You must be at least 18 years old to create an account and place orders.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree not to use the Platform for unlawful purposes or in any way that could damage, disable, or impair the service.
• All content you submit (reviews, vendor listings, product descriptions) must be accurate and not misleading.

3. Orders and Fulfilment

Nighsell acts as a marketplace intermediary. Contracts for the purchase and sale of products are formed directly between customers and vendors.

• Delivery — vendors offering delivery will ship orders within their stated coverage radius. Estimated delivery times are provided by each vendor and are not guaranteed by Nighsell.
• Pickup — for pickup orders, you must collect the item from the vendor's specified location during the agreed time window.
• Order availability depends on vendor stock and operating hours. Nighsell is not liable for vendor non-fulfilment.

4. Payments

Payments on Nighsell are processed securely through Tap Payments, a certified payment gateway. By placing an order, you authorise the charge of the stated amount to your chosen payment method. All prices are inclusive of applicable taxes unless otherwise stated.

5. Vendor Responsibilities

Vendors registered on Nighsell are responsible for the accuracy of their product listings, pricing, and delivery information. Vendors must comply with all applicable laws and regulations in Oman, including consumer protection and food safety standards where relevant.

6. Intellectual Property

All Nighsell branding, logos, and platform content are the property of Nighsell. Vendors retain ownership of their product images and descriptions but grant Nighsell a non-exclusive licence to display them on the Platform.

7. Limitation of Liability

Nighsell is not liable for any indirect, incidental, or consequential damages arising from the use of the Platform or transactions between customers and vendors. Our total liability to any party shall not exceed the value of the order in dispute.

8. Governing Law

These Terms are governed by the laws of the Sultanate of Oman. Any disputes shall be subject to the exclusive jurisdiction of Omani courts.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
